2010 year in review

What have been the “Big Stories” for 2010 here at WoaB?

Well tops of the list is the saga of Martin Erzinger and his butt-buddy Mark Hurlburt. I you remember Erzinger is the hit-and-run driver that Hurlbert claimed was too rich to charge with a felony. I think you know my opinion of people too rich to prosecute, especially hit-and-run drivers…

A close second this year was the guilty plea and sentencing of Tasha Boreland, who was sentenced to 24 years in prison for hitting 3 cyclists who were not even riding in the road, killing 2 of them. With the other crimes she was found guilty of we won’t have to worry about her on the roads again until 2040, if then. Even if released early she may never be allowed to drive again.

After that was the rash of hit-and-run. We have had a massive number of stories from all over the world about drivers that leave the scene of a wreck. And it’s not just cyclists this is happening to, I get a number of stories about pedestrians, and other cars, that were hit by drivers that left the scene. so this is not a cycling story, but it is a road safety story which makes it a cycling safety story.

I think what comes to mind after that is the number of bike ninjas that were hit this year, which becomes the first story that is more about cyclists than drivers. I understand the philosophy behind riding ninja, but I don’t recommend doing it. However if you must ride ninja then you must ride like you are invisible, because you are, mostly.

Of course this is only the top stories that WoaB has covered. There were much more important stories about cycling infrastructure that were covered by other bike blogs, like Cyclelicious and BikinginLA, and let’s not forget BikePortland. I strongly suggest you read those with mine, I read them nearly every day. I also read Drunk Cyclist, but I don’t recommend that one for the under 21 crowd as the language gets pretty rough over there. Think of them as WoaB with less earthy spirituality and more earthy language. 😉

It’s my slow time of year, the Feed

Actually it’s only the slow time of year for the blog, I resemble a one-armed wall paper hanger. We just finished painting the last details on the Yellow Submarine costume yesterday, I have to give Blue a bath this afternoon, the performance is tonight, and I need to buy my wife’s birthday present before midnight tomorrow. I found out Wednesday that I will be stuck off-stage in my costume (sitting on Blue) for the entire show so that I can be part of the big finale escorting the guy portraying John Lennon out of the building along with the rest of the Yellow Submarine Krew (stage division) there being no way to get off Blue until the costume is cut off of Blue. Seriously this has been like a small army, fortunately I was a high-ranked soldier, not the HMFIC of the routine. I helped build the costume, which started out as a elaborate trailer with a model of the YS on it until we discovered that the combined trailer and bike were too big to make the turn at the top of the aisle across the stage. Months of work down the tubes (as well as about $100 in materials) because of a mistake in the original spec. I’m also on the stage division of the Krew because it’s my bike and I have experience riding bicycles on this stage. The scary part of this is the costume functions as a huge set of horse blinders that severely restrict my vision to the side, and I have to ride in circles on stage in a crowd of other performers that are not part of the Krew and whose costumes will not have much better vision than mine and the whole bunch of us will be in a space that tapers out from the turn area which was about 6 feet to maybe 15 and maybe 30 feet long. Yee-haw! At the end of the show the YS and Krew get behind “Lennon” and Amy Martin and escort them to the back of the hall, along with the rest of the opening procession.

Up first because if is the most infuriating thing I have had to put in the blog in years, the “trial” of Martin Joel Erzinger. I don’t care if you have to catch him spitting on the sidewalk to do it, get this POS in jail where he belongs. And “new car smell” made him wreck? That makes the “twinkie defence” look like a marvel of legal scholarship in comparison. Even the viewers of the Colbert Show think this stinks of privilege for the rich. Ditto the Daily Show viewers.

And another SWSS in KS. 76-year-old cyclist injured after crash with car on Kasold Drive After the previous links I’m all out of outrage for this one. Kick his car-driving butt! Meh! Hit from behind protocols for this one, along with a video camera on the bike and/or helmet to disprove the driver’s statement.

A bit off my game, the Feed

I’m running very late tonight as I had to work on the Yellow Submarine costume for the SolstiCelebration after visiting the Lab Rat Keeper. The good news is that my weight is exactly the same this morning as it was 2 weeks ago. The bad news is that every 15 minutes I lose use of my left arm as a machine tests my BP and pulse, but the data gathered is beyond value.

Up first is an article from right next door about the unfortunate situation on the Katy Trail in Dallas. Dallas Considers Safety Options for City Trails Unfortunately I don’t know that the proposed speed limit will do any good, because technically the trail is a highway and has a mandatory minimum speed limit of 30 MPH under TX law. I don’t know about you but most cyclists I know can’t hold that speed for very long.

Because there is no numerical standard of when a person is impaired by narcotics a doped-up piece of scum gets off with a slap on the wrist. The lawyers for Martin Joel Erzinger (remember that name rich readers, you don’t want your money tainted by his foul hands) are trying to say he was drunk on new car smell when he hit the liver transplant surgeon Dr. Stephen Milo and left him to die. ‘New Car Smell’ Cited In Hit-And-Run I would really like for them to try that, because that allows the felony charge to be reinstated. If the lawyers really use that argument then they are admitting he was driving while impaired which makes the hit-and-run a felony. Do it, do it!

Moving to the Great White North a killer driver claims obliviousness in a DUI hit-and-run. Driver who killed Ottawa teen cyclist pleads guilty to impaired driving causing death Yeah, that didn’t really work well in court either. “It is Daoud’s second impaired-driving conviction.” And with any luck it will be his last, as he never gets behind the controls of a motor vehicle again in his life.

In Enn Zed they believe in quick justice, the driver that killed 3 cyclists on the wrong side of the road has already been convicted less than 2 weeks after the wreck. Family of killed cyclist plead for caution Seriously, if we could get convictions like this in the US… As for how to avoid, you really have to be able to depend on drivers staying on the correct side of the road.

What is with all the crazies on the roads? The Feed

I’m beginning to think a psych profile test would be a good thing to include in the written portion of the driver’s license test, because there are some seriously crazy people driving cars out there just in my little suburb of Hell. I’m sure they don’t all live here that a random distribution will have pockets of crazy but seriously, WTF? I got passed on the left at a stop sign by someone that blew the stop sign while I was trying to make a left turn and signalling my turn! White Ford Explorer I’m watching for you to screw up again.

First today is a cyclist hit in an intersection by a Ford sedan, in CA. Bicyclist injured in collision with car Why do they assume the driver of the car had the green? Why is it always the cyclist that ran the red? Anyway, don’t run red lights or even yellows because you might get caught in the intersection when the light changes if you enter the intersection when the light is yellow. Also if the light cycle is really close you can enter on a green and still be in the intersection when the light changes to red, but that doesn’t appear to be the case in this wreck.

The cop that is accused of killing a cyclist after spending 6 hours in a bar is now an ex-cop. Town board fires Windsor Locks cop in fatal crash A cop can be fired for an “appearance of illegality” as proven by a preponderance of the evidence rather than by the “beyond reasonable doubt” standard in criminal cases, and as the cop was never tested for BAC% at the time of the wreck there is nothing that can be used in a criminal proceeding, but the security video of him spending 6 hours in the bar drinking something was more than enough evidence to get him thrown off the force.

Another former cop is facing homicide charges for hitting a cyclist from behind because he was driving with clinically impaired vision. Eaton Rapids Twp. man to stand trial crash that killed cyclist (w/video) The impact between the cyclist’s head and the passenger side mirror was so violent the remains of the mirror “exploded” into the vehicle. The driver admits to driving with impaired vision but claims the cyclist was riding “too far into the road” and not being a gutter bunny. Had the cyclist been in the middle of the road do you think the half-blind driver with Macular Degeneration might have seen him a bit better, or still hit him from behind with enough force to crush his skull?

Apparently the high-class scum that hit-and-ran against a cyclist and had the felony charges dropped because he was “too rich to prosecute successfully” forgot to file his report that he was charged with the felony so he may end up losing his job anyway. The Explainer: Failure to communicate Martin Joel Erzinger’s latest filing failed to disclose the felony charges against him in September, before the charges were dropped, which means he could lose his license to work in the securities field.

Meanwhile on the other side of the world, a cyclist is killed in Oz. The cyclist had no chance to avoid the wreck. more Driver faces charges after bike rider killed There was another wreck reported that appears to be a Oz version of the left cross where a driver turned right in front of and hit a cyclist who was going straight down the road in the opposite direction. To avoid this kind of wreck you have to use intersection protocols, except backwards from the US versions. Where we would turn hard right, in Oz, Enn Zed, the UK, and Japan you would be prepared to turn hard left to reduce the angle of impact and the severity of the wreck.

Sill in Oz, a driver is convicted of killing a cyclist. Death of cyclist The driver was doing almost 60 MPH in spite of only being able to see clearly for about 30 feet in front of him because of the angle of the sun. His lawyer tried to point out at least his client was sober and not taking drugs at the time of the wreck.

Infrastructure news from NYC. Escalating Bike Lane War at City Council Inspires Borough President to Break Into Song A major part of the issue here is that so little instruction has been given on how to use this bit of infrastructure, very few people know what to do with it. Seriously unless you’re a bike infrastructure wonk most drivers, pedestrians, and casual cyclists don’t know how to use a bike lane, not to mention all that bad education left over from the period when cycling was treated like playing in the street and people were told to ride facing traffic. I mean seriously, they mark a chunk of the street as a “bike lane” and people are supposed to know without any education how to use it? Did you know how to use a street the first time you saw one?

And that is all the news I can handle today. Tonight I have to go be fitted to a costume resembling the Yellow Submarine and finish making the costume, as well as other “churchy” things and I don’t know when I’ll be able to get the post up on Saturday. But Y’all have a nice weekend anyway, I’m going to try.
